A large steel fabrication company has been fined £135,000 and ordered to pay costs of £46,020, following prosecution related to the fatal accident involving a fork lift truck operator.
The operator was not wearing a seatbelt which was instrumental to fatal crush injuries suffered as a result of an incident that occurred. The company had failed to manage fork lift truck driving operations as they did not enforce the wearing of seat-belts or control the speed at which some fork lift truck operators drove.
Employers have a legal duty to assess risks and enforce control measures, and this includes ensuring safe driving practice of operators. Bad habits can slip in to every day practice.
